Adjustment of Status Work Permits Extended to Two Years

USCIS has announced on June 11, 2021 that work permits (employment authorization cards) for those applying for adjustment of status can now be issued for a maximum of two year. Previously, the card can only be issued for a validity of one year. This extension will apply to those applying for adjustment under the family and employment categories. USCIS did not announce an extension for travel documents (advance parole), which is still limited to one year. Previously, the AOS work permit and travel document were on the same card. It is unknow at this time if USCIS will issue separate cards for these two documents, or also extend the travel document validity in the future. This update, along with some other changes USCIS has brought forward, is in response to President Biden’s February 2, 2021 executive order instructing federal agencies to review immigration regulations, policies and guidance, and eliminate barriers to the Administration’s priority of promoting legal immigration.
