We are pleased to share the approval of a PERM-based I-140 petition for a graphic designer under the EB-3 professional category. The petition was filed under regular processing and approved in approximately 2.5 months, a notably fast turnaround given that regular processing has at times run well over a year.
Our client is a small business in California, and this was the company’s first time sponsoring an employee for a green card. First-time sponsors often find the PERM process demanding, because the employer carries the burden at every stage: obtaining a prevailing wage determination, running a documented recruitment campaign, and demonstrating to the Department of Labor that no able, willing, qualified and available U.S. worker was found for the role.
The company began the first steps of the process in the winter of 2023. Most of the time between then and the I-140 approval was spent on the prevailing wage and recruitment stages that the Department of Labor requires before a labor certification can be filed. Careful preparation at those early stages is what allows the I-140 itself to move quickly.
We are proud to have guided this employer through its first PERM sponsorship and on to a successful I-140 approval for its employee. If your company is considering sponsoring an employee for a green card, schedule a consultation and we can walk you through what the process involves.
