On Thursday, three immigration groups filed a lawsuit against Immigration and Citizenship Enforcement (ICE) on behalf of nine people being held in Virginia detention facilities. This is one of many lawsuits being filed around the country. The immigration groups are arguing that the detained individuals have medical conditions that make them especially vulnerable to serious illnesses or death if they are infected with COVID-19. This is a violation of their constitutional right to safety and therefore they should be released immediately.
This lawsuit comes after immigration groups filed an emergency motion to halt in-person immigration hearings on Wednesday. For more information, please click here. So far, DOJ have closed 11 immigration courts across the country through April 10. All hearings of cases of immigrants who are not in detention have been postponed. Immigration judges, lawyers, and prosecutors have expressed their frustrations on the DOJ’s slowness to act. They have urged DOJ to close more courts for the safety of themselves and the immigrants. There are an another approximately 60 courthouses across the nation that are still currently operating.
