
The National Interest Waiver (NIW) is a unique green card option that allows certain foreign nationals to bypass the traditional labor certification process and obtain permanent residency in the United States. Because it is categorized under the EB-2 (Employment-Based Second Preference) visa, there is a common misconception that you absolutely must hold a Master’s or PhD to apply.
The answer is yes, it is entirely possible to qualify for the NIW without a Master’s or PhD degree.
While holding an advanced degree is the standard path, U.S. immigration law provides alternative ways to meet the threshold requirements. It is critical to understand that these education or skill qualifications are just the “ticket to entry.” You must first meet the threshold to even be considered for the merits assessment of your case.
Path 1: The Advanced Degree Equivalent
If you do not hold a Master’s or doctorate, you can still qualify under the “Advanced Degree” category through what is known as the Bachelor’s plus five rule.
To utilize this pathway, you must possess:
- A U.S. Bachelor’s Degree (or its foreign equivalent).
- At least five years of progressive work experience in your field following the attainment of that degree.
What is “Progressive” Experience?
“Progressive” is the keyword here. It is not enough to simply have held the same entry-level job for five years. USCIS wants to see evidence that your responsibilities have increased in complexity over time. This might include promotions, management of teams, handling larger budgets, or taking on more sophisticated technical tasks. By combining your Bachelor’s degree with this substantial experience, USCIS considers you to hold the “equivalent” of an advanced degree.
Path 2: The Exceptional Ability Pathway
For individuals who do not have a Bachelor’s degree, or who have a degree but lack the five years of experience, there is a second option, the Exceptional Ability pathway.
“Exceptional ability” is defined as a degree of expertise significantly above that ordinarily encountered in the sciences, arts, or business. To qualify for the threshold under this path, you must meet at least three of the following six regulatory criteria:
- Official academic record showing a degree, diploma, certificate, or similar award from a college, university, school, or other institution of learning relating to your area of exceptional ability.
- Evidence in the form of letter(s) from current or former employer(s) showing that you have at least ten years of full-time experience in your occupation.
- A license to practice the profession or certification for a particular profession or occupation.
- Evidence that you have commanded a salary, or other remuneration for services, which demonstrates exceptional ability.
- Evidence of membership in professional associations.
- Evidence of recognition for achievements and significant contributions to the industry or field by peers, governmental entities, or professional or business organizations.
The Real Challenge: The Matter of Dhanasar Test
Meeting the threshold requirements (Advanced Degree or Exceptional Ability) is only the first step. It simply allows you to walk through the door. To actually win the National Interest Waiver, you must satisfy the three-prong test established in the precedent case Matter of Dhanasar.
Regardless of whether you have a PhD or 10 years of experience, you must prove the following to the satisfaction of the adjudicator:
1. Substantial Merit and National Importance
Your proposed endeavor must have substantial merit and national importance. This focuses on the specific project or work you intend to do in the U.S. It must be shown to benefit the United States in a significant way, such as advancing a field of study, improving public health, enhancing U.S. competitiveness, or contributing to economic growth.
2. Well-Positioned to Advance the Endeavor
You must demonstrate that you are well-positioned to advance your proposed endeavor. USCIS will look at your resume, your past record of success, your skills, and your current progress (such as having customers, investors, or intellectual property). They want to ensure you are not just dreaming of a project, but are actually capable of executing it.
3. Balancing Test
Finally, you must show that, on balance, it would benefit the United States to waive the standard requirement of a job offer and labor certification. This prong emphasizes the potential urgency or unique impact of your work. You are essentially arguing that the U.S. benefits more from letting you start work immediately than from forcing you to go through the slow labor certification process designed to protect U.S. workers.
