How to Self-Petition for an EB-2 NIW Green Card

The EB-2 National Interest Waiver (NIW) is one of the most powerful pathways to a Green Card for talented professionals, as it allows them to bypass the lengthy labor certification process and, most importantly, self-petition without needing an employer sponsor. This unique feature provides a level of freedom and control that is rare in the U.S. immigration system. However, this flexibility comes with a high evidentiary standard.

Understanding the EB-2 NIW Framework

To successfully self-petition for an EB-2 NIW, you must satisfy two main prongs of eligibility.

Prong 1: Basic EB-2 Eligibility

First, you must qualify for the general EB-2 category. This can be done in one of two ways:

  • Advanced Degree: You must hold a master’s degree or higher, or a bachelor’s degree followed by at least five years of progressive, post-baccalaureate experience in your field.
  • Exceptional Ability: You must demonstrate exceptional ability in the sciences, arts, or business. This is typically shown by meeting at least three of a specific list of criteria, such as professional licenses, a high salary, or recognition for your achievements.

Prong 2: The National Interest Waiver

This is the core of the NIW petition. You must prove that waiving the standard job offer and labor certification requirement is in the national interest of the United States. To do this, you must satisfy a three-part test established in the landmark case Matter of Dhanasar:

  1. Your Proposed Endeavor Has Both Substantial Merit and National Importance. You must clearly define what you plan to do in the U.S. (your “proposed endeavor”). This work must have significant value and its impact must be national in scope. Fields like science, technology, healthcare, and entrepreneurship often meet this criterion, but it is not limited to STEM.
  2. You Are Well-Positioned to Advance the Proposed Endeavor. This is where you must demonstrate your own unique qualifications. Evidence can include your education, skills, track record of success, progress toward your goals, and a clear plan for the future. You need to convince the government that you are the right person to carry out this important work.
  3. On Balance, It Would Be Beneficial to the U.S. to Waive the Job Offer Requirement. Finally, you must argue that the value you bring to the U.S. is so significant that it outweighs the standard interest in protecting U.S. workers through the labor certification process. This often involves showing that your contributions will create jobs, advance a critical industry, or provide other tangible benefits to the nation.
