It does not focus as much on the nature of the business activity or the applicant’s education or credentials, as long as the business appears sufficiently profitable to maintain the required 10 jobs.
The Key to EB2-NIW Eligibility: Impact and Credentials
The EB-2 NIW pathway focuses on the nature of the applicant’s specific business project, and whether it presents a unique and significant benefit to a field. For example, semiconductor technology, cybersecurity, a branch of medical science, aerospace engineering, veterans welfare, etc.
The evaluation considers the society, a region, or nation as a whole, and whether the applicant has the skills and experience to advance the project. The applicant also needs to meet the EB-2 threshold requirement by either having an advanced degree (a Master’s degree or higher, or a Bachelor’s degree and 5 years of progressive work experience in the same field).
Unlike the EB-5, the applicant does not need to personally invest their own money into the project and is not bound by the job creation requirements either.
Strategic Considerations
When is the EB-5 the Right Fit
The EB-5 can be a great fit for applicants who have a clear source of funds and have sufficient amount of personal capital to invest, and those who seek options to concurrently file an I-485.
One strategic advantage to the EB-5 pathway is that for Rural, High Unemployment Area, and Infrastructure projects, the visa bulletin is “Current” as of the date of writing. This means applicants may concurrently file an I-485, application for adjustment of status to permanent resident with their initial I-526 immigrant investor petition, if they are already in the United States on a non-immigrant status.
Even though the I-526 will take many years to adjudicate, having a pending I-485 means the applicant may continue staying in the U.S. while the petition is being adjudicated. If the applicant also applies for a concurrent I-765 (application for employment authorization) and I-131 (travel authorization), the applicant may work and travel internationally while they are waiting for the petitions to be adjudicated.
Staying for a prolonged period out of status while the I-485 is pending is not without risk, but it is considered an authorized period of stay and can be a practical option for many investors.
When is the EB-2 NIW the Right Fit
The EB-2 NIW can be a great fit for applicants who seek faster adjudication, and those who have projects that have an outstanding potential to influence the field but are not driven forward by a high-dollar amount personal investment, or that rely on investments by third parties.
With the premium processing option available, the EB2-NIW can be approved within 45 business days. For nationals of countries other than China and India, even with the 1.5 year backlog, the EB2-NIW may still be the quicker option than the EB-5 to ultimately obtain the green card.
The other significant advantage of the EB2-NIW is that entrepreneurs and professionals who do not necessarily have the personal capital of $800,000 (or $1.05 million), but nevertheless play a critical role in advancing a business project, perhaps funded by other entities such as VC investors or via a much lower amount of start-up capital, could qualify for the green card. They do this by showing the business project’s prospective impact on advancing the field, or substantially benefitting the economy of a region or the nation.
