An E-2 Visa is a Visa Classification that is available for foreign nationals who wish to live in the U.S. to develop and direct the operations of a business. The business can be large or small and an E-2 Visa is a great Visa option for those who want to start a business. In order to qualify for the Visa, applicants must meet specific requirements and these requirements are outlined in an article you can access by clicking here. 1. Does an E-2 Visa Lead to A Green Card?
No. An E-2 Visa is a non-immigrant Visa and does NOT lead to a Green Card. While it does not lead to a green card, it is often approved for a 5-year period and as long as the business is still in operation you can renew the Visa indefinitely. If you qualify for another green card category (eg. EB-5) you should consult an immigration attorney to explore the best way to apply for the green card. This can be a tricky area as the temporary intent aspect of the E-2 Visa makes applying for a green card difficult. 2. Do I have to hire U.S. employees in Order to Get an E-2 Visa?
There is no required number of U.S. workers that have to be hired to work in the business but usually the business should employ at least some employees in the U.S. as reasonably necessary for the business to operate. If no workers are hired, the investment may be considered as a business that is set up only to support the E-2 applicant and his/her family. (The legal term for this is “Marginal” and it is not permitted). You do not have to hire the workers immediately and your 5-year business plan should detail exactly when you plan to hire the employees. 3. Is an E-2 Visa the Visa where I have to Invest 1 Million dollars ($1,000,000) and hire 10 employees?
No. The E-2 Visa is often confused with an EB-5 Visa. The EB-5 Visa is a completely different Immigrant (Green Card) Visa and you can read more about and EB-5 Visa by clicking here. In contrast to an EB-5 Visa, an E-2 Visa does not require a specific amount of Investment and does not have a specific number of employees that you have to hire.
4. Can I get an E-2 Visa with a low amount of Investment? Is there a minimum amount of an Investment?
There is no required Investment dollar amount. A common myth is that a minimum of $100,000 is the required but Scott Legal, P.C. has obtained approval for investments with as little as $15,000 spent and $35,000 in a bank account as working capital. If your business is a service business (eg. a consulting business) the investment that is required will be much lower than if your business is a capital-intensive business (eg. car manufacturing plant). 5. Can I borrow money to start the business?

6. Is there a particular type of business that I have to start or buy?
No. Any for profit active business type is fine. (eg. drug store, law firm, consulting agency, car dealership, hair salon, etc.).
7. Do I have to Make a Business Plan to Get an E-2 Visa?

8. Does an Investment in Real-Estate Qualify for an E-2 Visa? Can I buy a Home and get an E-2 Visa?
No. The E-2 Visa can be obtained by either purchasing an existing business or creating a new business in the United States and the business must be an “active” business. This excludes passive investments like real-estate or owning stock. Your business must also make money and as such not-for-profit enterprises are excluded.
9. Can I bring my family and can they work in the U.S.?
Your husband or wife can get an E-2 visas and are eligible to apply for an “Employment Authorization Document” (referred to as an EAD) to work in the United States after obtaining E-2 status. He/She can work in any field and this is a significant advantage of an E-2 Visa as many other non-immigrant visas, like a TN Visa and an H-1B Visa, do not allow a spouse to work in the U.S.. 10. Which countries are eligible to get an E-2 Visa?
The E-2 Investor Trader Visa is only to people from the countries that the U.S. has a Treaty with. Many Western countries are on the list but there are also countries from Africa, Asia and the Middle East on the list. Israel was just recently added to the list. 11. How long does it take to get an E-2 Visa?
An E-2 Visa is a very document intensive petition. In addition to a number of government forms, the Visa requires the submission of a binder full of documentation that is often quite lengthy. Once the documentation is prepared, the processing time depends on the processing time at the consulate that is located in the applicant’s country. This could range from 3 weeks to 3 months (or longer).
12. How much does it cost?
Legal fees for an E-2 Visa will be $6,500 for most E-2 Visas.
13. Do I need a lawyer?
Yes. Like most Immigration law, the E-2 regulations are complicated and you must demonstrate to immigration officials that you have met all of the legal elements. In addition, the documentation requirements for an E-2 Visa are quite extensive and a legal brief must be written linking all of the elements of the Statute to your case.

I’m looking at purchasing an ‘established pool route’ in Florida in the region of $50-$80k, sometime in the near future. They all show hefty profits ranging from $60-$90k per year, working as a employer only route.
If I was to do a 5 year business plan, as the first year there would be no employees taken on, then looking at 1 per year for the next few years after that (as I would invest a sum of the profits to expand the pool route to gradually build quite a large business).

You can only work for the E-2 company but you can own real estate and buy stock and sell it as long as it is not a business.

Hello, It depends where you apply. If you get a visa at a Consulate, then you can leave and enter. IF you do a change of status, you cannot do this.
Is there any way to travel outside the US and come back if the status is changed to E2 within the US?
If you go to Canada or Mexico for less than 30 days you should be able to reenter but this is not guaranteed. You could also always apply for a visa when you leave.

The I-797 notice is not a visa so if you want to travel and reenter the country, you will have to go to a Consulate to get a visa issued. If your spouse only has an I-797 approval (change of status) then you will not be able to get a visa at the Consulate until he/she gets one.

You could do a change of status or go to the Consulate and the timing depends on which you select. You can certainly start the process and then go back to your home country and process there. The pros and cons of processing at a consulate v. in the U.S. really need discussion so a consultation would work best. I have a quick question. My brother in law applied for E2 Visa which has just got denied yesterday. He still has not received the package which contains the reason of denial. He , along with his family, came to USA on B1/B2 visa and got 6 months entry which expired on June 02, 2017. Although they filed their E2 before June 02 2017 but as they have now received their E2 decision, what is their current legal status in USA? Would they be considered as legal? They applied their E2 through a lawyer and at the moment their lawyer has suggested them to wait until we receive the package which contains the E2 denial reason and we can see if we can reattempt or not.
I am checking with you the worst case option; if for e.g. they don’t get the reattempt or reconsideration chance, what options they have to stay legal in USA? There is a scenario over which I’d like to hear the odds:
– I am Italian Citizen (and Brazilian, living in Brazil).
– My wife (10 years marriage) is Brazilian, and we never looked for her Naturalization as Italian through marriage
– Nevertheless, we communicated Italy regards the marriage, sending all documentation, etc. So Italy is aware about this.
– I am willing to apply for a E2, but, due the skills/know how, I’d be the best choice to look for a job on the market – Work Permit.

Hello, I need help answering the following question:
There are several foreigners (“employees”) working in the USA via an E-2 visa. These employees qualify for an E-2 visa based on their work, skills, and abilities- this is not disputed. Previously, these employees worked for an employer in their native country. Is it allowable for these employee’s former employer from their native country to pay the employee’s new employer in the USA to teach the employees American etiquette, culture, and some English language? Teaching American etiquette, culture, and language to the employees will not interfere with the employee’s daily work in any way. In fact, this additional teaching will better help the employees in all aspect of their job. When the employees’ E-2 visas expire, they might return to their native country to work for their former company.
Is the above allowed? I think it’s allowed because it does not violate any of the E-2 visa requirements in that the employees are following all requirements of the visa.

I had an E2 visa with my ex-employer (05/2016 -> granted for 5 years, renewal every 2 yrs) who I worked for for many years. I went to the US in July to work with them until I had to go back to my home country (family emergency) in October for personal reasons and therefore quit my job. Now, 4 months later (and working with an other company), I would like to go back to work with them and there were signals they are looking for me to come back anyway.
Would we have to do the entire E2 visa process all over again or would be sufficient if they’d hire me for the same position again as it is still vacant?

I came to the USA on B1/B2 visa and thought that I would find a good business during 6 months. Unfortunately things didn’t work as I planned and my B1/B2 visa expired; however before the expiration date I appled for student visa and still waiting for the approval. I did it because I thought I can find any business that matches my requirements and during the waiting period I can immidately apply for E2 visa. Finally I found one Business and asked the broker to put escrow terms to the aggreement and if i don’t get an approval for E2 visa, all my money will be returned to me. However the seller doesn’t agree with this term and he says that I can buy the business then apply for E2 visa. Is it a true story? Is there is a chance that I don’t get an approval for E2 visa if I’m going to invest in a gas station business that costs $150,000? I’m scared of loosing my money. Because I don’t want to operate a business here illegally.

I’ve been reading a lot of info about the E-2 visa but I still don’t get one point: in my specific case, I’d like to open a small new business with my wife (not buying an already existing one), so I understood the best way to get the E-2 approval would be to invest some money in a “irrevocably committed” way, such as a leasing contract, buy some equipment, hire people etc but at the same time I understood I can’t do it with a tourist visa (ESTA), so this is what I don’t get: how can I spend this money and do all these stuff before applying for the E-2 visa? Do I need a B-1 visa?
I just found out yesterday about the B-1 visa almost by accident, and that would make sense, but at the same time it would be hard to show some strong relationship with my country because, in order to spend some months in the US looking for the right place, before I should leave my job, and my current house is registered at my parent’s name, so I’m quite confused about the best war to proceed.
I really hope you can help me clarifying this point.

Hello – I am currently on a TN visa and my wife has a TN visa as well (both Canadian citizens).

I am a Turkish citizen. The company I work for has an office (which acts like a separate entity but both offices have some common shareholders) in the West coast for 2 years. They want to hire me for the US office now. Employers of the US office are under E2 visa. So I was wondering if the E2 visa for employee is a better/easier option for me compared to L1 or H visa.
Also, can I apply in my country directly or does my employer have to apply from the States? I know that E2 is multi-entry, but once I have the visa , is there any limitation how often one can leave US for travel, either business or tourism, and come back?
I am currently in Turkey and hold a B1/B2 visa. I have been to the States on tourist/business purposes 3 times before. The last time I legally stayed for 5 months for an extended vacation. Would that be an issue?

Hi Ian, I’m from the UK and I’m interested in purchasing an old run down property with some land and running it as a vacation rental business out there. The property I’m looking at is small and there’s currently only one building but there’s 5 acres of land so real potential for growth. My wife is an italian citizen and I am Brazilian. Italy is part of the E2 treaty but brazil is not. So here are the questions:
1) Is it possible to do the E2 process under her name although I made most of the earnings ? Would our child and I be able to get papers as well ?

I am married to a guatemalan women and have 5 children, all under 21 years of age (14, 11, 6, 4 & 1); My mother (73) is a US citizen and my sister (40) was born in the USA and has a psycology practice in New York. My father is from Nicaragua so I have also the nicaraguan citizenship.
I invested $50K in an industrial cleaning equipment from a dallas based company (Stripco Soda Blasting) in April 2014 to develop a business in Guatemala. Due to high altitude, extreme humidity and dew point related technical issues I could never managed to run the equipment efficiently, it just would not work in the central american region.
I decided that needed to send back my equipment to the USA but the company from which Inbought it would not accept the machine back, therefore I been thinking about starting a “soda blasting service” business in Florida since these equipments work perfectly in US climate, market is already knowledgable about this cleaning technology and stimulated by the amount of companies that offer this service.
I am currently registering an LLC to comply with tax and legal US requirements but definetly my company would need my execution and management to develop.

E-2 is fine for tourism as I assume you are still in valid E-2 status. If your E-2 status is no longer valid (ie. you do not work for the employer or the company does not exist), you should get another visa.
