Can a letter of support from a local governmental office help strengthen an NIW petition?

Many of you may know that a letter of support from a government agency or office, such as a Congressperson in your district or a federal agency covering a particular field, like the Department of Energy (DoE), are very favorable to an EB2 NIW (national interest waiver) petition.

Although this may seem like a daunting element for a prospective element to try and obtain, it may be comforting to know that letters of support from smaller or more local levels of government, such as the City, regional, or community level, can also work in your favor.

This can be especially helpful if you are an entrepreneur who provides services to improve public infrastructure at a local level, for example, and you are collaborating with municipal agencies or governments for these projects, and these officers can provide an explanation of why this work is important for the welfare of the community and advance regional interests. Similarly, if you are an entrepreneur creating business in a locality where business development in your field is particularly needed or welcomed for the region’s economic prosperity as a whole, you could get in touch with a government official covering that region for a letter confirming such benefits and explaining why your presence in that state or locality is important to the public good.

NIW petitions are highly dependent on the narrative each applicant builds that explain why the applicant’s work goes beyond merely benefitting one’s immediate employer or clients, but offer broader benefits in the public interest that can be argued as having national importance.  In this process, the USCIS looks for evidence of such national importance, for which letters issued by government-affiliated representatives can be of great help.
