USCIS has announced on September 3 that they have extended time that receipt notices can be used as evidence of permanent residence status for Form I-751 and Form I-829 applicants from 18 months to 24 months. USCIS has provided this extension as a response to the long processing times at USCIS and the long wait times at the service centers.
Form I-751 is a removal of conditions for marriage applications. Marriage applicants are given a conditional Green Card valid for an initial 2 years. Before the expiration of the card, the applicant must submit a Form I-751 to remove conditions on their green card and apply for a permanent card. Given the long wait times for applications to be processed the applicants can use their Form I-751 receipts along with their expired Green Cards and continue to receive all of the benefits of permanent residence status. Form I-829 is a removal of condition for an EB-5 investor green card application. The EB-5 program, also known as the Million Dollar Green Card, allows investors to obtain a Green Card if they invest the required amount of funds in business or projects that will create 10 full time jobs. To learn more about the program, please click here. EB-5 applicants are also given a 2 year conditional green card. Before the expiration of the card, the applicant must submit a Form I-829 to remove conditions of their card and apply for a permanent card. Form I-829 applicants will now also receive a 24-month automatic extension on their green cards with the receipts.
The 24-month extension to apply automatically to all new applications submitted after September 4. USCIS will also issue new receipt notices to eligible conditional permanent residents who have properly filed their Form I-751 and Form I-829 before September 4 and whose cases are still pending. The receipts will serve as evidence that an application was properly filed.
