One of our Scott Legal lawyers received an approval on an O-1 petition that he recently worked on. Despite the client’s extensive experience and qualifications in the motion picture and television industry, as well as having already been in the United States on two consecutive O-1 visas, a Request for Further Evidence was issued questioning certain aspects of his work, including the nature of his collaborative team work and whether an audio engineer can actually play a lead role in a film production. Upon filing a response countering each issue raised in the RFE and a thorough legal analysis of the O-1 regulatory framework, the case was approved. The client is based in New York.
