
One of our clients was just approved for a B-1 visa at the U.S. Consulate in London. The applicant had used another attorney to apply for an E-2 visa and was not successful and subsequently hired us to process their E-2 visa. When an E-2 visa (or other visa) is denied, ESTA (Visa Waiver) is no longer valid and the applicant must apply for a B1/B2 visa. A B-1 (for business) or B-2 (tourism) visa can be issued for up to 10 years for multiple entry. Normally when an E-2 visa is denied, an applicant must enter the U.S. to remedy some of the issues associated with the filing so applying for the visa can allow for this. In this case, the visa was issued for 1 year.
