
Beneficiaries under the initial designation for Temporary Protected Status, “TPS” for Venezuela that have been residing in the United States since March 8, 2021, will be eligible to re-register or renew their TPS and apply for a new employment authorization document if they continue to meet eligibility requirements. These individuals must re-register during the 60-day re-registration period from September 8, 2022 to November 7, 2022. Furthermore, the United States Citizenship and Immigration Service, “USCIS” will automatically extend the validity of Employment Authorization Documents, “EAD” previously issued through September 9, 2023 since it is unlikely that new EADs will be issued before the expiration of the previously issued EADs.
Finally, for individuals with pending TPS applications, form I-821 and EAD application form I-765 based on Venezuelan TPS eligibility, new applications are not required since the USCIS will approve these applications under Venezuelan TPS through March 10, 2024.
As a reminder, Venezuelans who maybe eligible for TPS protection under the existing designation and have not yet applied should do so before September 9, 2022, which is the initial application deadline. We previously discussed TPS designation for Venezuela here.
