Scott Legal is happy to announce that USCIS has approved a TN petition for a Management Consultant. The employee, a national of Canada, had been denied before working with our firm. Once the approval arrived, he entered the United States and immediately received TN status to work as a Management Consultant.
We submitted the case to USCIS while the employee was outside the U.S. Most Canadian professionals request TN status in person from U.S. Customs and Border Protection at a port of entry, where an officer decides the application on the spot. Filing with USCIS first is a less common route. The case is reviewed in advance, and the applicant then travels with an approval already in hand.
The TN visa, created under NAFTA and continued under the USMCA, allows qualified Canadian and Mexican professionals to work in the United States in a defined list of occupations. Management Consultant is one of them, and it is one of the few TN categories where an applicant can qualify with five years of relevant experience instead of a bachelor’s degree.
That flexibility is also why the category draws close scrutiny. Officers look carefully at whether the position is genuine consulting work, built around a defined business problem and advisory duties, rather than a permanent internal role carrying a consultant title.
