
We are pleased to share a recent H-1B change of status approval for a marketing manager from Vietnam who received a job offer from a technology company in California. The applicant had entered the United States on a B-1/B-2 visa and was seeking a pathway to begin employment in a specialty occupation role.
Although the applicant did not participate in this year’s H-1B lottery, the case had a strong advantage. The applicant had previously been selected in an earlier H-1B lottery but did not use the full six years of H-1B status at that time. Our team successfully demonstrated eligibility to recapture the remaining unused time from the initial six-year period. This approach allowed the applicant to obtain H-1B status without reentering the lottery process, which can be highly competitive and uncertain.
