We are pleased to announce an E-2 investor visa renewal approval at the U.S. Consulate in Toronto. The applicant, a national of Canada, was granted the renewed visa for five years.
The company is a tax consultation business based in Arizona.
An E-2 renewal is not a formality. The E-2 treaty investor visa lets nationals of treaty countries, including Canada, live in the United States to develop and direct a business in which they have invested, and each renewal asks whether that business still qualifies.
At renewal, the focus shifts from projections to results. The renewal review looks at how the business has actually performed: whether it is operating and generating revenue, whether it has hired U.S. workers, whether it remains more than marginal, and whether the investor still owns at least half of it. Tax returns, financial statements and payroll records carry much of that evidence.
Many investors worry about falling short of the projections in their original business plan. Missing those figures does not automatically defeat a renewal, because projections are reasonable estimates rather than binding commitments, but the company’s actual results need to support continued qualification.
If your E-2 visa is approaching expiration, or you are a Canadian entrepreneur weighing a business in the United States, schedule a consultation to discuss your next steps.
