Proclamation suspending entry of certain H-1B, H-2B, J-1, and L visa workers extended until March 31, 2020

On December 31, 2020, President Trump extended the Proclamation 10014 that suspends visa issuance to:

  • H-1B or H-2B visa workers (and any alien accompanying or following to join such alien)
  • J visa workers, if they are participating in an intern, trainee, teacher, camp counselor, au pair, or summer work travel program (and any alien accompanying or following to join such alien)
  • L visa workers (and any alien accompanying or following to join such alien)

This proclamation was originally signed on April 22, 2020 (and was valid for 60 days), and President Trump later extended the proclamation until December 31, 2020.

On December 31, 2020, President Trump extended the proclamation again, this time until March 31, 2020. Within 15 days after December 31, 2020 and every 30 days thereafter, the Department of Homeland Security along with the Department of State may recommend any modifications as necessary.

Will the new administration terminate this Proclamation?

At this point, it is hard to predict whether what the future Biden administration will do regarding this proclamation, as we have not heard any official statements regarding this topic yet. The current administration could terminate this proclamation immediately (on January 20, 2020), couple days after, or they could also just let the proclamation stay in effect, and not extend it after March 31, 2020.
