New H-1B Database Website to be Unveiled on April 1

USCIS will unveil a new website on April 1, 2019 that will expand on the amount of H-1B petitioner data available to the public. The new website will reportedly allow members of the public to search for H-1B information by company name, year, NAICS industry code, city, state, or zip code. This will give the public the ability to calculate approval and denial rates, and review which employers are using the H-1B program. The H-1B visa is a non-immigrant visa that permits a company to hire workers in specialty occupations.  This visa category requires that the beneficiary (the foreign worker) have a Bachelor’s degree, and the Petitioner (the U.S. company) can employ the worker for up to six years.  To learn more about the H-1B visa and your eligibility, please click here. Currently, there are limited set of H-1B data available that can be found on the USCIS and Department of Labor websites. Interested parties can also search for Labor Condition Applications that have been submitted or certified on the Department of Labor iCert website by company name, state, and year.  A Labor Condition Application (Form ETA 9035) is an application submitted to the Department of Labor providing specific information about the petitioner, the job for which the H-1B visa is sought and the wage that the petitioner commits to pay to the H-1B employee. It is a requirement that a certified Labor Condition Application be included with the petition at the time of the H-1B filing in order for the case to be approvable. To learn more about LCA’s and the new rules, please click here.
