Do I have to show ties to my home country when applying for L-1 visa?

By July 6, 2020May 26th, 2021Immigration, L-1 Visa

An L-1A visa is a great visa for an employee or owner of a company abroad who wants to transfer to a U.S. office or open a new office in the United States.

If you are applying for an L-1 visa at a U.S. Consulate abroad, you may be wondering if you should bring evidence showing ties to your home country/evidence showing that you keep your permanent residence abroad to the interview.

The short answer is: no. L-1 visa is a dual intent visa. This means, that you can remain in the U.S. in lawful status even though you have an immigrant intent. Additionally, the fact that you want to apply for a green card does not preclude you from obtaining L-1 visa. Therefore, when applying for an L-1 visa, you do not have to show ties to your home country/evidence showing that you have a permanent residence abroad.

On the other hand, if you are applying for a B visa, you will absolutely have to demonstrate that you have ties to you home country and that your stay will be temporary.
