DHS Designates Ukraine for TPS

The Department of Homeland Security announced on March 3, 2021 that Ukraine has been designated for Temporary Protected Status (TPS) as a result of Russia’s invasion on Ukraine. TPS is granted to certain groups of people in the wake of natural disasters, wars, outbreaks of disease, and other catastrophes that would make it difficult for them to return safely to their home countries. Government officials periodically review the program to decide whether to extend it, and most groups have received regular extensions in the past. Please click here to learn more about TPS.

Individuals eligible for TPS under this designation must have continuously resided in the United States since March 1, 2022. Individuals who attempt to travel to the United States after March 1, 2022, will not be eligible for TPS. Ukraine’s 18-month designation will go into effect on the publication date of the forthcoming Federal Register notice. The Federal Register notice will provide additional instructions for applying for TPS and an Employment Authorization Document (EAD). TPS applicants must meet all eligibility requirements and undergo security and background checks. DHS has also recently extended South Sudan’s TPS and granted TPS to Sudan.
