The applicant, a national of Mexico, was on an F-2 spousal visa and was granted a change of status to E-2 investor for two years to develop and direct a cross-border business consulting firm. The applicant had previous experience in comparative law, project management, and entrepreneurship, and will serve as the CEO of the company. The applicant’s spouse, previously on F-1 OPT, was granted a change of status to E2S, which provides work authorization incident to status. For applicants already in the United States on a valid nonimmigrant status, a change of status petition can be filed with USCIS to change to E2 status, and applicants can request premium processing to receive a decision within 15 days. The business will be based in Florida.
