Can I register my E-2 company at multiple Consulates?

An E-2 visa is a visa category for entrepreneurs who want to either start or buy a business in the United States. Sometimes the E-2 company may benefit from being registered as an E-2 Company at more than one Consulate, mostly if the company is large and is bringing a lot of E-2 employees.

Example

You are a national of France. You originally applied for an E-2 investor visa at the U.S. Consulate in Toronto and your company is registered as an E-2 company there. You applied for your initial visa there and you have renewed your visa twice there already. You now want to bring an E-2 employee to the U.S. who lives in Paris and would like to attend his interview in Paris. You are wondering whether this is possible and what would this process entail.

The answer is that you can have your E-2 company registered at multiple Consulates. Each Consulate has a different procedure so you would need to check the Consulate’s specific instructions or reach out to the Consulate and inquire about what the submission procedure would be. Generally though, you would need to register your company at the new Consulate, and the fact that it’s already registered at some other Consulate would not matter. This means, that even though you obtained your investor visa at the Consulate in Toronto in 2010 and since then you have renewed the visa twice, you would still need to submit a brand new E-2 petition to the Consulate in Paris (e.g. explaining your original investment made in 2010). In the example above, this means that you would still need to follow the instructions of the Consulate in Paris and register the Company with the Consulate in Paris and the fact that the company was already registered with the Consulate in Toronto would not matter.

The new company registration would generally be filed together with the E-2 employee’s petition, but again you should check the instructions of the particular Consulate where you want to apply at what is the procedure.

The advantage of having the company registered at 2 Consulates is mostly for large companies that bring a lot of E-2 employees to the U.S. and especially if the company’s employees are located in 2 different countries. This makes it convenient for them to attend the E-2 visa interview appointment.
