May 2023 Visa Bulletin Shows EB-1, EB-2, EB-3, and EB-5 Retrogressions and Final Cutoff Dates

Due to an increase in demand, the State Department announced retrogression and final action cutoff dates for certain EB-1, EB-2, EB-3, and EB-5 applicants. The May Visa Bulletin lists the following cutoff dates for the issuance of specified immigrant visas or adjustment of status applications:

  • For the EB-1, India and China both have cut off dates of February 1, 2022, while all remaining countries will continue to be current.
  • The EB-2 cutoff date for India will continue as January 1, 2011. The May Visa Bulletin also revealed that it is likely that India’s EB-2 category may retrogress in June. However, efforts will be made in October of 2023 to return the final action date to January 1, 2011. For China, the cutoff date will be June 8, 2019. All other countries will retrogress to February 15, 2022.
  • For EB-3 professionals and skilled workers, India’s cut off date will remain June 15, 2012, while China’s will advance to April 1, 2019. All other countries will have a final action date of June 1, 2022.
  • The EB-5 unreserved categories consisting of, C5, T5, I5, and R5, will have a final cutoff date of September 8, 2015, for China and June 1, 2018, for India. All other countries as well as the EB-5 rural, high employment, and infrastructure categories will continue to be current. The May Visa Bulletin also stated that it is likely that India’s EB-5 category may retrogress in June. Efforts will be made in October of 2023 to restore the final action date to June 1, 2018.
