If you are Canadian or Mexican national and you have an offer from a U.S. company to work in a profession that is listed on the NAFTA profession list, you could qualify for a TN Visa. You may be wondering whether your family can come to the U.S. if your TN visa/status is approved. The short answer is: yes. Your immediate family (spouse and unmarried children under 21) can accompany you to the U.S. and can be admitted in a TD classification. Can my spouse work in the U.S. on TD visa? No. Unfortunately, your spouse cannot work in the U.S. when he/she is in the U.S. in a TD status. Can my spouse study in the U.S. on TD visa? Yes. Your spouse can also enroll into a University while in the U.S. on TD visa/status. Can my children study in the U.S. on TD visa? Yes. Your children can study in the U.S. on TD visa but your children cannot work in the U.S. Does my spouse have to be Canadian/Mexican national to qualify for TD visa? No. Your spouse does not have to be Canadian/Mexican national to qualify for TD visa. My spouse is Canadian, can he/she apply for a TD status at the border? Yes. Your spouse will have to show the TN holder’s Canadian passport, proof of relationship to the TN visa holder (original marriage or birth certificate for children), and copy of the TN’s holder’s I-94. Please note that if your spouse is not a Canadian citizen, he/she will have to apply for a TD visa at a Consulate and cannot apply for the TD status at the border.
