E-2 Treaty Investor Visa – A Great Visa Option For Those Who Wish To Start A Small Business In The United States – Top E-2 Visa Questions & Answers

By February 20, 2013September 20th, 2022E-2 Visa, Immigration, Investor Visas, Questions & Answers

An E-2 Visa is a Visa Classification that is available for foreign nationals who wish to live in the U.S. to develop and direct the operations of a business.  The business can be large or small and an E-2 Visa is a great Visa option for those who want to start a business.  In order to qualify for the Visa, applicants must meet specific requirements and these requirements are outlined in an  article you can access by clicking here. This article focuses on the top E-2 Visa questions asked by our clients.  The answers are short answers to complicated questions and should only be used as a basis for a discussion with a qualified immigration attorney.

Here are the top E-2 Visa questions.

1.     Does an E-2 Visa Lead to A Green Card?

No.  An E-2 Visa is a non-immigrant Visa and does NOT lead to a Green Card.  While it does not lead to a green card, it is often approved for a 5-year period and as long as the business is still in operation you can renew the Visa indefinitely.  If you qualify for another green card category (eg. EB-5) you should consult an immigration attorney to explore the best way to apply for the green card.  This can be a tricky area as the temporary intent aspect of the E-2 Visa makes applying for a green card difficult.  See more detail on this in our Article “Does an E-2 Visa Lead to A Green Card” topic by clicking here.

2.     Do I have to hire U.S. employees in Order to Get an E-2 Visa?

There is no required number of U.S. workers that have to be hired to work in the business but usually the business should employ at least some employees in the U.S. as reasonably necessary for the business to operate.  If no workers are hired, the investment may be considered as a business that is set up only to support the E-2 applicant and his/her family. (The legal term for this is “Marginal” and it is not permitted).  You do not have to hire the workers immediately and your 5-year business plan should detail exactly when you plan to hire the employees.  Find out more about marginality and hiring employees in our article “What Does the Marginality Requirement Mean for an E-2 Visa?” by clicking here.

3.     Is an E-2 Visa the Visa where I have to Invest 1 Million dollars ($1,000,000) and hire 10 employees?

No. The E-2 Visa is often confused with an EB-5 Visa. The EB-5 Visa is a completely different Immigrant (Green Card) Visa and you can read more about and EB-5 Visa by clicking here.  In contrast to an EB-5 Visa, an E-2 Visa does not require a specific amount of Investment and does not have a specific number of employees that you have to hire.

4.     Can I get an E-2 Visa with a low amount of Investment? Is there a minimum amount of an Investment?

There is no required Investment dollar amount.  A common myth is that a minimum of $100,000 is the required but Scott Legal, P.C. has obtained approval for investments with as little as $15,000 spent and $35,000 in a bank account as working capital.  If your business is a service business (eg. a consulting business) the investment that is required will be much lower than if your business is a capital-intensive business (eg. car manufacturing plant).  Read more about the differences between an E-2 visa and an EB-5 visa by clicking here.

5.     Can I borrow money to start the business?

Yes. Unlike the EB-5 Visa, borrowing money is fine for this Visa as long as the business is not overly leveraged.  You can also receive a gift.  Find out more about gifts and loans by reading our article “Can an E-2 Investment be from a Gift or Loan?” by clicking here.

6.     Is there a particular type of business that I have to start or buy?

No. Any for profit active business type is fine. (eg. drug store, law firm, consulting agency, car dealership, hair salon, etc.).

7.     Do I have to Make a Business Plan to Get an E-2 Visa?

Yes.  A 5-year business plan is required and the business plan is a key element that immigration officials consider when they review your Visa petition.  To find out more about how to make an effective business plan click here.

8.     Does an Investment in Real-Estate Qualify for an E-2 Visa? Can I buy a Home and get an E-2 Visa?

No.  The E-2 Visa can be obtained by either purchasing an existing business or creating a new business in the United States and the business must be an “active” business.  This excludes passive investments like real-estate or owning stock.  Your business must also make money and as such not-for-profit enterprises are excluded.

9.     Can I bring my family and can they work in the U.S.?

Your husband or wife can get an E-2 visas and are eligible to apply for an “Employment Authorization Document” (referred to as an EAD) to work in the United States after obtaining E-2 status.   He/She can work in any field and this is a significant advantage of an E-2 Visa as many other non-immigrant visas, like a TN Visa and an H-1B Visa, do not allow a spouse to work in the U.S..  See more about the spousal work authorization by clicking here.

10.  Which countries are eligible to get an E-2 Visa?

The E-2 Investor Trader Visa is only to people from the countries that the U.S. has a Treaty with.  Many Western countries are on the list but there are also countries from Africa, Asia and the Middle East on the list.  Israel was just recently added to the list.  A complete list of the countries on the list can be found by reading our Article “Which Countries are Eligible for an E-2 Visa?” by clicking here.

11.  How long does it take to get an E-2 Visa?

An E-2 Visa is a very document intensive petition.  In addition to a number of government forms, the Visa requires the submission of a binder full of documentation that is often quite lengthy.  Once the documentation is prepared, the processing time depends on the processing time at the consulate that is located in the applicant’s country.  This could range from 3 weeks to 3 months (or longer).

12.  How much does it cost?

Legal fees for an E-2 Visa will be $6,500 for most E-2 Visas.

13.  Do I need a lawyer?

Yes.   Like most Immigration law, the E-2 regulations are complicated and you must demonstrate to immigration officials that you have met all of the legal elements.  In addition, the documentation requirements for an E-2 Visa are quite extensive and a legal brief must be written linking all of the elements of the Statute to your case.

    Hi,

I’m currently on TN visa with a different organization. I’ve independently filed a provisional patent on the spinal implant. One surgeon really liked my concept and ready to invest in developing a product. I don’t have money to invest but I’ll be the main technical person. We want to go in for 50-50 partnership. He will be bringing in seed money to develop a prototype while my patent will serve as my investment. What are my options if I want to go full time to work for this organization. Do I’ve a chance to get an E2 visa without putting any money (my contribution is only $5000) in this startup? Please advise.

Hi so I’m from Canada and I’m planning to move my clothing brand to the US in a few years most likely under the E-2 Visa and I will most likely be hiring at least 1 person. I was wondering if $50,000 would be enough to meet the requirements of being excepted.

    Thank you, Ayden

  • alan thompson says:

I’m looking at purchasing an ‘established pool route’ in Florida in the region of $50-$80k, sometime in the near future. They all show hefty profits ranging from $60-$90k per year, working as a employer only route.
If I was to do a 5 year business plan, as the first year there would be no employees taken on, then looking at 1 per year for the next few years after that (as I would invest a sum of the profits to expand the pool route to gradually build quite a large business).
Does this sound like a viable option for an E2 Visa, and do you know if it has been done before?

  • Ali haider says:

    Hello,
I have restaurant business in Toronto,Canada. We have been running profitable for over 6 years now. I am planning to open new restaurant in Bay Area. Not a necessarily a branch. My wife is an IT professional so she has more opportunities out there. I am wondering if E2 would be ideal for us in order to purchase an existing small restaurant (<$80 to $100K) bay area and startup. What type of investment would be required. We are Canadian citizens.

    • IanScott says:

Hello, That certainly would work for an E-2 visa and 100K would be sufficient for a restaurant that had employees.

      Here is some more info.

Is there any directory of companies working under E2 visa and hiring E2 employees? Or a website listing companies or job offers for E1/E2 employee visa?

    HI,

I’m holding a Jordanian national, having B1/B2 visa and would like to visit US and apply for E2 visa. my question is:

    1. how long it will take to get the approval for the visa.
    2. is it possible to hire an attorney to proceed with the visa and I come back to my home until the visa obtained? or I should stay in US till the visa approved?
    3. in case I got the visa, is it allowed to return back to my country and the visa will stay valid? or once I leave US and visa will be canceled and I have to obtain a new one?

    many thanks in advance

    • IanScott says:

You could do a change of status or go to the Consulate and the timing depends on which you select. You can certainly start the process and then go back to your home country and process there. The pros and cons of processing at a consulate v. in the U.S. really need discussion so a consultation would work best. E-2 visas for Jordan are issued for 3 months but then you are given 2 years when you arrive. This also needs discussion. Please let me know if you would like to set up a one hour consultation. Kind regards,

Hi, thanks for the article and quick replies! A quick question please!
My cousin is on e2 visa (just recently got it approved) and has a coffee shop but wants to sell it and start a new shop at a different location( still in california) my question is, if there is a term of lets say half a year between two stores, will his e2 visa be taken away?? Or is there a grace period where we have some time to look for and open another shop else where? Thanks in advance !

    • IanScott says:

Hello, the visa is applicable only for the business it was issued for and if that business stops, the visa is no longer valid. This is a short answer to a complicated question so please set up a consultation if you wish to discuss further. Kind regards,

Hi I applied for E2 visa since April 2017
    And still under adminstrations inspection.
And now I am in USA as I established the company. And need to change the intity of the company to another State. Do I have to inform the embassy. Or I can not do that according to my application?

  • Asif says:

    Hi Sir,

I have a quick question. My brother in law applied for E2 Visa which has just got denied yesterday. He still has not received the package which contains the reason of denial. He , along with his family, came to USA on B1/B2 visa and got 6 months entry which expired on June 02, 2017. Although they filed their E2 before June 02 2017 but as they have now received their E2 decision, what is their current legal status in USA? Would they be considered as legal? They applied their E2 through a lawyer and at the moment their lawyer has suggested them to wait until we receive the package which contains the E2 denial reason and we can see if we can reattempt or not.
I am checking with you the worst case option; if for e.g. they don’t get the reattempt or reconsideration chance, what options they have to stay legal in USA? Should they be looking for F1 visa option ? Would you like to take this case by helping them in changing their status using any other visa option?

    Thanks
    Asif

  • Bradley says:

    Hi,
I would like to purchase a bar or restaurant in the USA, and feel the E2 visa would be by far the best way for me to do this. However, have never worked in a bar or restaurant, but I did do a business administration apprenticeship when I left school, and still work in business admin now. Do you think this could help me in getting an E2 visa? Or do I not have much chance with never working in a bar or restaurant?

    Thanks for your help.

Hello. Congratulation on this article, well write and the QA section with plenty information.
There is a scenario over which I’d like to hear the odds:
    – I am Italian Citizen (and Brazilian, living in Brazil).
    – My wife (10 years marriage) is Brazilian, and we never looked for her Naturalization as Italian through marriage
    – Nevertheless, we communicated Italy regards the marriage, sending all documentation, etc. So Italy is aware about this.
    – I am willing to apply for a E2, but, due the skills/know how, I’d be the best choice to look for a job on the market – Work Permit.
If I get everything right, the applicant CAN NOT apply for the work permit, just the spouse, would you know if my wife could apply for this E2 just because she married me, even not being naturalized as Italian?
If not, is there any chance to the applicant (in that case myself) get a work permit?
    Best Regards, Scott team.

First of all, thank you for the great article. My friends and I (3 people) are willing to invest in a business in the U.S. Each of us will invest an equal amount or over $150,000 each. We plan to purchase an existing business. Is it possible for all three of us to obtain E-2 visas as direct owners of the business in the U.S.? Or should we (1) set up a parent company A in our country, (2) have company A purchase company B in the U.S., which will be Company A’s subsidiary, then (3) apply for E-2 visas as managerial employees? The goal is for three of us to invest together and obtain E-2s together. I greatly appreciate your time.

Hello, i wanted to ask, if i am holding an E-2 Visa, can i import a car for personal use and what are the restrictions on the car? Do i need to send it back or will i be able to sell it in the US when i no longer need it or if i’m leaving?

Hi, I’m working on an E2 Visa for a company that is filing bankruptcy now. If I would find another job offer, would I be able to apply for another E2 visa while still working for my current employer? Since I am German, would the new company would have to have there headquater in Germany or EU or does it matter at all?

    Thank you!

    • IanScott says:

Hello, you could apply for an E-2 visa as an Investor if you start your own company or as an E-2 employee if you get hired by a company that was owned by German nationals. We would be happy to assist. Please contact us if you would like to set up a consultation to discuss options.

  • Steve says:

    Hi,

Assuming I already obtained my E2 Investor Visa and I own over 50% of the company. However as my business grows I plan to have investment from VC’s and my ownership of the company may go below 50% in the future.
What happens to the visa that I already have? Do I loose the status when the ownership goes below 50%?
Does USCIS know when this happens?

  • Jim says:

Hello, I need help answering the following question:

There are several foreigners (“employees”) working in the USA via an E-2 visa. These employees qualify for an E-2 visa based on their work, skills, and abilities- this is not disputed. Previously, these employees worked for an employer in their native country. Is it allowable for these employee’s former employer from their native country to pay the employee’s new employer in the USA to teach the employees American etiquette, culture, and some English language? Teaching American etiquette, culture, and language to the employees will not interfere with the employee’s daily work in any way. In fact, this additional teaching will better help the employees in all aspect of their job. When the employees’ E-2 visas expire, they might return to their native country to work for their former company.

Is the above allowed? I think it’s allowed because it does not violate any of the E-2 visa requirements in that the employees are following all requirements of the visa.

  • Simone says:

    Hi –

I had an E2 visa with my ex-employer (05/2016 -> granted for 5 years, renewal every 2 yrs) who I worked for for many years. I went to the US in July to work with them until I had to go back to my home country (family emergency) in October for personal reasons and therefore quit my job. Now, 4 months later (and working with an other company), I would like to go back to work with them and there were signals they are looking for me to come back anyway.

Would we have to do the entire E2 visa process all over again or would be sufficient if they’d hire me for the same position again as it is still vacant?

    Kind regards
    Simone

    Hello there,
I came to the USA on B1/B2 visa and thought that I would find a good business during 6 months. Unfortunately things didn’t work as I planned and my B1/B2 visa expired; however before the expiration date I appled for student visa and still waiting for the approval. I did it because I thought I can find any business that matches my requirements and during the waiting period I can immidately apply for E2 visa. Finally I found one Business and asked the broker to put escrow terms to the aggreement and if i don’t get an approval for E2 visa, all my money will be returned to me. However the seller doesn’t agree with this term and he says that I can buy the business then apply for E2 visa. Is it a true story? Is there is a chance that I don’t get an approval for E2 visa if I’m going to invest in a gas station business that costs $150,000? I’m scared of loosing my money. Because I don’t want to operate a business here illegally.

    Hello,

I’ve been reading a lot of info about the E-2 visa but I still don’t get one point: in my specific case, I’d like to open a small new business with my wife (not buying an already existing one), so I understood the best way to get the E-2 approval would be to invest some money in a “irrevocably committed” way, such as a leasing contract, buy some equipment, hire people etc but at the same time I understood I can’t do it with a tourist visa (ESTA), so this is what I don’t get: how can I spend this money and do all these stuff before applying for the E-2 visa? Do I need a B-1 visa?

I just found out yesterday about the B-1 visa almost by accident, and that would make sense, but at the same time it would be hard to show some strong relationship with my country because, in order to spend some months in the US looking for the right place, before I should leave my job, and my current house is registered at my parent’s name, so I’m quite confused about the best war to proceed.

I really hope you can help me clarifying this point.

Thanks a lot for your help guys and regards from Italy!
    Alessandro

    Hello

I live in a western country and willing to run a bar in the states. Is it possible to get the e2-visa by owning a bar and spending an amount of 100-120K?

How long would it take and is there any real chance or should I make some more money first?

And I’m pretty busy at the moment. Would you be able to manage a full-service, including helping me with the buying process?

    • IanScott says:

Thank you for contacting us. This amount should be sufficient for an E-2 visa at most consulates. We would be happy to set up a one hour consultation to discuss the E-2 visa further and assist you. Please let me know if you would like to set something up.

    Hello,

I am a Turkish citizen. The company I work for has an office (which acts like a separate entity but both offices have some common shareholders) in the West coast for 2 years. They want to hire me for the US office now. Employers of the US office are under E2 visa. So I was wondering if the E2 visa for employee is a better/easier option for me compared to L1 or H visa.

Also, can I apply in my country directly or does my employer have to apply from the States? I know that E2 is multi-entry, but once I have the visa , is there any limitation how often one can leave US for travel, either business or tourism, and come back?

I am currently in Turkey and hold a B1/B2 visa. I have been to the States on tourist/business purposes 3 times before. The last time I legally stayed for 5 months for an extended vacation. Would that be an issue?

It could be great if you could email me your fee for the entire process if I am to hire you for my application.

    Thank you in advance
    Regards

    • IanScott says:

Thank you for contacting us. If your E-2 visa is denied, that should not impact your B-1/B-2 visa unless the reason for the E-2 denial was misrepresentation or they had some issue where they questioned the veracity of the information.

Hi, I have an E2 and I’m an Australian Citizen. I applied with the USCIS here in the US, not with the Embassy in Australia. However, I need to travel to Canada on a business trip. Can I get the E2 visa stamped in Canada? Or will I absolutely have to travel back to Australia to get my E2 visa stamped?

    • IanScott says:

Thank you for contacting us. To reenter the US you will need an E-2 visa. This is not just a visa stamp but a reapplication. Please note that the USCIS approval does not govern and the consulate will start from scratch. Canada may accept your application but not during the summer. Kind regards,

    Hi Ian,

Me and my husband are planning to enter into franchise agreement and set up a business in the US and exploring E-2 visa requirements. According to FDD the total investment is about $300K, which mostly includes build out cost and will be spent over 6 months. Do you know if we can apply for E-2 in the beginning of this process when we spent, say, only $15K or we have to wait till we spent more considerable amount? Also does your company accept clients from Canada, giving that we probably will be applying in Canada?

    Thank you

    • IanScott says:

Thank you for contacting us. We regularly process E-2 visas for Canadians at the Consulate in Toronto and would be happy to help you. In fact, the firm was founded on an E-2 visa by a Canadian.

In order to apply for the E-2 visa, you would have to have the premises set up and it would not be sufficient just to purchase the franchise license. We would be happy to set up a one hour consultation to go over a possible strategy.

      Kind regards,

I am British Citizen, came in US on E2 visa and invested $126,000 in a franchise business with a US Citizen with a 51% share. Company provides job to 25 people which is gone up to 32 now. I got my first extension in 2014. And this year I started another Franchise Business in a partnership in Las Vegas, which provides job to another 8 people and signed a lease for another location which will open in July and provides job to 15 more people. But all my Businesses are not showing profits but also not Losses as well. Will their be any problem in getting extension.

Good evening. Can I apply to get an E-2 VISA investing 100.000 USD in a new company, and at the same time open a new company selling my consulting services (like 1099)?

    Thanks.

    • IanScott says:

Thank you for contacting us.. $100,000 could be sufficient for an E-2 visa and the actual investment amount depends on the business and other factors. You can only work at the E-2 business so you would not be able to set up an additional business but you could perhaps include that business in your initial plan. Please contact us if you would like to set up a consultation.

Hi Ian, I’m from the UK and I’m interested in purchasing an old run down property with some land and running it as a vacation rental business out there. The property I’m looking at is small and there’s currently only one building but there’s 5 acres of land so real potential for growth. I would like to add more cabin style buildings and create a kind of glamping style vacation rental space on the land. The initial property is cheap at about $50,000 but obviously I would spend more fixing it up. I’m wondering if I would qualify for the E2 with this business? I also run a sound healing practice practice and would like to build a small studio where people could come and experience holistic therapies but that would be a bit later down the line. Looking forward to hearing what you think, thanks,

    Hello Ian

My wife is an italian citizen and I am Brazilian. Italy is part of the E2 treaty but brazil is not. So here are the questions:

    1) Is it possible to do the E2 process under her name although I made most of the earnings ? Would our child and I be able to get papers as well ?

    2) We already have a case at the INS, for family visa, under the F3 category, would we be denied the E2 visa because of it ?

    Thanks

    • IanScott says:

Thank you for contacting us. If you gift your wife the funds, it does not matter who earned them. Your children up to age 21 would also get an E-2 visa but would not be able to work. This should not impact the case (but it could) as long as the priority date is in the far future.

Let’s say if I make a 40,000 investment to buy 50% of a business. and I would make additional amounts of investments ( 10K ) to Renovate remodel and all that good stuff. Is that considered to be part of the investment from an immigration stand point ?

Also, If I would apply for the visa and the only mean to support myself is thru a decent paycheck based on the hours that I work ( for now, until the business starts making profits which might take 3-4 years to do so ) , assuming I get pregnant and need to take some extended time off ( maternity before and after the baby delivery which will effect the ” marginal “factor to support my self . How will immigration view this when it comes to renewal of the E2?

  • I am a british citizen (born in England, 1970) who lives in Guatemala, central america for 14 years. I am married to a guatemalan women and have 5 children, all under 21 years of age (14, 11, 6, 4 & 1); My mother (73) is a US citizen and my sister (40) was born in the USA and has a psycology practice in New York. My father is from Nicaragua so I have also the nicaraguan citizenship.

I invested $50K in an industrial cleaning equipment from a dallas based company (Stripco Soda Blasting) in April 2014 to develop a business in Guatemala. Due to high altitude, extreme humidity and dew point related technical issues I could never managed to run the equipment efficiently, it just would not work in the central american region.

I decided that needed to send back my equipment to the USA but the company from which Inbought it would not accept the machine back, therefore I been thinking about starting a “soda blasting service” business in Florida since these equipments work perfectly in US climate, market is already knowledgable about this cleaning technology and stimulated by the amount of companies that offer this service.
I am currently registering an LLC to comply with tax and legal US requirements but definetly my company would need my execution and management to develop.

Do you think I will be eligible for an E-2 Visa?

    • IanScott says:

Thank you for contacting us. The answer depends. If the investments are for passive investments, that is fine. If you are investing in another company, you would need work authorization or to expand the E-2 visa. Please contact us if you would like to set up a consultation. Kind regards,

    Dear Scot,

I am a British Citizen running my own business for last 14 years in London, thinking of expanding into USA, our business has changed in the recent past due to various policies of the country, therefore, we had to change our business model to suite to our clients all over the world and the right place to offer services from is USA.

Though, we have considered EB5 initially, but considering the long delays, speculative investment with REGIONAL CENTRES where the principal amount as well as lifting the conditions on GREEN CARD at the end of second year is alarming and can lead to life changing events should we fail to obtain the GREEN CARD, Wondering whether we can go on E2 and establish the business in the meantime my spouse can locally (while we stay in USA) apply for EB5 $ 1 Million Dollar Scheme where we operate our business rather than investing into Regional Schemes. Do we qualify for EB5 in that case and whether we can take the bank loan to cover $ 1 million investment?

    • IanScott says:

Thank you for contacting us. An E-2 visa is certainly an option and also an L visa may be an option. You can apply for a green card through the EB-5 program with both of these visas but the L visa would permit entering and exiting the U.S. while the petition was outstanding. Please contact us if you would like to set up a consultation to discuss.

We look forward to hearing from you.

      Kind regards,

I am from Egypt and nowadays i am in the US having a B1/B2 visa and want to convert it to E2 visa knowing that i will invest 30000 USD in a books selling company that have two stores and will open a third one in a month period and in which i will fully operate , the net profit of one store is approximately 50000 equivalent to 40% margin, so does this investment support me in having the E2 visa.
    thx

    • IanScott says:

This investment amount is likely too low. The investment needs to be substantial so you should be at least $50,000 if processing a change of status. Please contact us if you would like to set up a consultation.

I ‘ m from Brazil. I am interested in E2 visa but Brazil do not make part of treaty and not eligible for this visa.

My mom, has a american citizenship because she married with an american. I know about F3 VISA Third preference, but this kind of visa generally waste 8 years to obtain.

My question, in this my scenario are there any possibility to immigrate with visa E2, with any sponsorship through my mother ?

My mom doesnt have funds to prove a sponsorship for me because she is retired.

My idea is open a Gas Station in Orlando or West Florida – ClearWater, Sarasota, Tampa, etc. for this plan I have an amount of US$ 150.000,00.

I research about E2 visa and found about Argentina which has a treaty for E2. Argentina is integrant of Mercosul and it is not difficult to obtain a Temporary Residence and DNI. It is sufficient to apply for E2 Visa ?

I hope hear about any suggestion.

Hi there. Does an E2 visa cancel a B1/ B2 visa? My E2 visa expired in 2013, but my B1/B2 visa is still valid until 2018. Can I still travel as a tourist to the US of A? Many thanks,

    Amy

    • IanScott says:

Thank you for contacting us. It really depends. The E-2 should not impact the green card but it may be tough to get an E-2 visa issued if you have a green card petition outstanding. It will depend on the nature of the petition. For example, if it is a sibling petition that was filed with a long wait, then the E-2 may still be issued. Please set up a consultation to discuss further. Kind regards,

  • Shahid Hussain Shera says:

Saudi Arabia is not a Treaty country. An L visa may be an option if you have a business outside of the U.S. or an EB-5 visa if you have $500,000 or $1,000,000 to invest. Please contact us if you would like to set up a consultation.

    • IanScott says:

Hello, you can apply for an E-2 visa but you should contact us immediately if you would be out of status if the B1/B2 extension was denied. Your spouse could get an E-2 visa when you are married. Please contact us to set up a consultation if you have additional questions.

Can i buy a gas station and hire someone to run it because i have work in another country …. I dont want to stay in usa … I want to start the work and move to usa after 3 years

    • IanScott says:

      Hello,
Anyone can buy a business in the U.S. and have others run it. This should be planned carefully though if you are visiting the U.S. after you purchase the business. Buying a business does not require a visa but working in the U.S. does. If you have any further questions, please feel free to contact us for a consultation. Kind regards,

  • Jord says:

Hello,I have just read someone else’s post on here about renewing a e2 visa but didn’t really understand it,so can you renew without leaving the usa?

    • IanScott says:

Yes, you can renew as many times as you like without leaving the U.S. but if you leave the U.S. after a renewal, you would have to be re-approved at the consulate. The approval in the U.S. is not a “visa” but rather an extension of status.

  • Paul says:

Hi are personal secured loans a elidgeable source of funds for the e2 visa and will I be able to use all the loan to buy the bussiness without using my own money? Thanks Paul.

    • IanScott says:

Hello and thank you for contacting us. A personal secured loan is fine as long as the loan is secured with personal assets (not the assets of the business). Please contact us if you would like to set up a consultation. Kind regards,

      • Paul says:

Thanks for the reply.iam a homeowner where I live now so if I secured it on that would that be eligable? And how would I give proof of the funds if I got it from a loan company? And if it is from a loan company could I still use the loan for the full investment? Thanks.

        • IanScott says:

Thank you. Yes. that would be eligible. For further questions, please feel free to set up a consultation at your convenience. Our $250 fee is applied towards your final bill if you decide to hire us. Kind regards,

  • Sunny says:

If an E-2 visa holder’s business has proven to be marginal, and now the USCIS is asking for data before proceeding to renew his visa, can he present a new business plan for an entirely new venture?

The old or existing business just did not work.

But the E-2 investor has another business plan, in a completely unrelated area of business, which is much more promising. In fact they have started making good money on this new venture. Will the USCIS renew his E-2 visa if they find that this new business plan could work?

    • IanScott says:

Thank you for contacting us. Your question is a complicated one and we welcome the opportunity to set up a one hour consultation with you to discuss. Our consultation fee is $250. Please let me know if you would like to go ahead with this. Kind regards,

    Hi
Regarding E2 visa , can investor get visa for her / his key employers as well ? And they should apply at the same time as investor ?
    Thank you

    • IanScott says:

Yes. An E-2 visa can be E-2 investor, E-2 employee or E-2 dependent. It is best to apply for them at the same time but not required. Please contact us if you would like to set up a consultation.

  • Lee says:

Hi there I have just read your post on the loans for e2 visas and thought if I got a loan of say $150,000 could I use all of that money to buy a bussiness or has some of it got to come out of my own money?

    • IanScott says:

      Hello,
If it is a loan for the full amount of the investment, it should be secured against personal property. Please let us know if you would like to set up a consultation if you have any questions.

      Kind regards,

      • Lee says:

Oh okay so I will have to get a secured loan of like I said of about $150,000-$200,000 and I get buy a business using just the loan and non of my money. Could you please tell me how much your consultations are, thanks

I always go to the usa for business but this time, I will go for holiday.
Can I come with the e2 visa or do i need to take an esta as well?
    Thanks,

    • IanScott says:

E-2 is fine for tourism as I assume you are still in valid E-2 status. If your E-2 status is no longer valid (ie. you do not work for the employer or the company does not exist), you should get another visa.

    • IanScott says:

You can renew here through an extension of status or you can go back to your consulate. The documentation that is required is generally the same but the consulate will issue a visa so you can leave and enter the country.

      • Andy lawson says:

Right so I can stay in the USA and renew it the there rather than go back home and do it there?

Is there a minimum budget I need to have if above is not enough?
    Please advise.

    • IanScott says:

Thank you for contacting us. The amount could be fine for an E-2 visa depending on how much it costs to set up the business. Please contact us if you would like to set up a consultation to discuss further. Our consultation fee is $250 and that amount is applied towards your final bill should you decide to hire us.

    • IanScott says:

Thank you for contacting us. Your E-2 status ended the day the company was no longer an E-2 entity. As such, you may currently be out of status and accruing unlawful presence. You should consult with a lawyer to discuss options. After 180 days of unlawful presence, you are subject to a 3 year bar. Please contact us if you would like to set up a paid consultation. Kind regards,

    • IanScott says:

E-2 Visa holders do not have any restrictions regarding getting mortgages so should be able to get one without a problem. You will have to check with your bank but there is not any general restriction. Citibank for example, would give a person on an E-2 visa a mortgage. Kind regards,

Dear Sir, thanks for providing this information. It is really helpful.
I’m a Canadian citizen, seriously considering to go for E2 visa in the very near future. Currently I’m in the US on TN status working as management consultant cum data analyst. My background is in consulting, marketing research, data consulting and also in filmmaking. My educational background is both in engineering and in MBA. I have several achievements in my filmmaking career as well (Selections of my short films in prestigious film festivals and some media attention). I want to open a consulting company which can offer consulting services in data management, data processing, data analysis and market research etc. Under the same consulting company, I also want to offer film production/video production services as well. So, my question is, is that possible under E2 visa? I dont see any problem because I have skills and experience in both areas and I can offer that under one consulting/services company. Also, I believe that in some ways both fields are inter-related too (use of software and technical tools). What will be the minimum investment needed for this and how can your firm help me in this? Finally, is it possible to get this done as fast as possible-lets say in 2 months after I decide to go for this route? Thanks so much in advance!

    Hello,

My partner and I are considering bringing a successful UK franchised company to the US as our own entity (we have obtained a licensing agreement from the UK). I am already in the US and will look to raise investment here. This will likely lead to shares in the company being offered.

Question 1. My partner and I will be even partners in this venture. If the investor receives shares in exchange for investment capital, my partner and I will own less than 50% each. e.g. 20% to the investor, 40% to myself and 40% to my partner – would this still satisfy the E2 requirements, and could we both obtain E2 status with this setup?

Question 2. Can the capital obtained come from a US investor?

    Thanks,

    • IanScott says:

Thank you for contacting us. The question is not straight forward and requires a fairly detailed explanation. I will give the short answer here though. The U.S. entity must be 50% owned by a member of a treaty country. Once that condition is satisfied, you can look at who can get visas. Visas can either be investor visas or employee visas. If investor visas, each investor must own 50%. If an E-2 investor with one E-2 employee (and you can do this even if the employee owns shares), then you can have a different mix. The control of the investors will also impact this analysis but there is not problem with the investors being U.S. investors. Please contact us if you have any further questions and we can set up a one hour consultation with one of our lawyers. You can contact us at info@legalservicesincorporated.com. Kind regards,

    Hello,
Me and my sister are from Israel, we are in the procces of getting Goergian passport. we are very intersted in the E2 visa program. we wanted to know if we invest together the amount can be 100k? or each one of us should invest 100k, total of 200k all together?
    Thank you for your answer.

    • IanScott says:

Thank you for contacting us. We regularly process E-2 visas and would be happy to help you. Although Israel is not an E-2 treaty country yet (expected very soon), you can use your Georgian passport and process the visa in Israel. For two investors, we recommend as high an investment as possible. There is no absolute number but you should aim for the $200K in your example. Please contact us at info@legalservicesincorporated.com if you would like to set up a one hour consultation with one of our lawyers. Kind regards,

      Hello,

Thank you for contacting us. A loan for E-2 is possible whether the loan is obtained in the UK or in the U.S.. You may have a tough time getting a loan in the U.S. without a credit history though. We would be happy to set up a one hour consultation with one of our lawyers to further discuss. We look forward to hearing from you. Kind regards,

what is the initial required investment for e2 visa. i am interested in investing in my brothers business which requires total of 100,000 investment. my share of investment would be 50,000 dollars which is half of the total investment. my questions is do i need to pay my share 50000 in one go or is it possible to pay initially 30,000 and after getting e2 visa invest the rest in the business?

    • IanScott says:

The investment amount depends on the business and the facts and circumstances. We have processed applications with investments of 50K but you may be able to use the 100K and then do an employee E-2. I recommend you set up a one hour consultation so we can give you legal advice. Please contact us at info@legalservicesincorporated.com if you would like to set something up. Kind regards,

Can you tell me that i am eligible for switching form b1/b2 visa to E2 Visa from USA ? or i have to fly back to UK for E2 visa stamp ?

    • IanScott says:

Dear Sir, If you entered on visa waiver, you cannot change status in the U.S. so you would have to go back to the UK. If you entered on a B visa, you could change status in the U.s.. Please contact us to set up a consultation if you have additional questions. Kind regards,

in the other word e2 is single entry or multiple entry
    regards,

    • IanScott says:

Generally you would have to get the visa again if you left after 3 months. (but if you did not leave the U.S. you would have 2 years) This requires additional explanation and would be happy to do this over a consultation. Kind regards,

I came USA first time on B1/B2 visa and apply E2 case during my stay and got approval from USCIS on April 15 ,2014. I did make $100000 initial investment as treaty investor . After getting E2 USCIS approval notice I went back immediately to my treaty country to get E2 stamp from local US consulate
but consulate denied my application with no reason . I had my valid B1/B2 visa and I did travel back to USA . Now I am in USA but My E2 USCIS notice is no more longer valid as I left country so what next options I have to make my status . My E
2 business is still running , I am earning and paying tax . Please advise

    • IanScott says:

Hello, We would be happy to discuss your case with a consultation. I strongly recommend you set up a consultation immediately to learn your legal options and to ensure that you maintain valid status. Please contact us and we can set up a one hour consultation with one of our lawyers. You need a lawyer to review your documents and determine why the application is denied. E-2 visas are usually processed by lawyers and a USCIS approval does NOT mean that a consulate will approve.

I am a dual Canadian/ Pakistani national currently residing in Lahore Pakistan. I have a Canadian Passport. Am I eligible to apply from the USA embassy in Pakistan? I do not have a Pakistani passport but I am legally resident here on account of my dual nationality. Or do I need to go back to Canada although I am not a resident there as of now.

    • IanScott says:

Hello. You could apply in Pakistan or in Canada. My suggestion is that you apply in Canada. Please touch base with us to set up a one hour consultation with one of our lawyers so we can explain this reasoning and explain E-2 Visas. Kind regards,
