Scott Legal just had another Canadian TN approval. The applicant was granted the visa for 3 years under the category of Engineer. Under engineering related applications it may be problematic to obtain an approval since an applicant’s engineering related degree does not always match up perfectly with duties of the position offered by the employer. In our case, the application had to connect the employer’s job duties for the position of business analyst to the normally performed job duties of an engineer which in this case was that of an industrial engineer.
The connection was accomplished by highlighting the applicant’s education course work and experience that matched with the job’s duties within the context of the typical duties of an industrial engineer. TN applications for Canadian nationals can be adjudicated at a port of entry; Mexican nationals applying for TN visas must do so at a U.S. Consulate or U.S. Embassy. It is recommended to call the port of entry in advance of applying given the current situation with COVID-19.
